The Plain Dealer | Cases Involving Deceased Rape Victims Proving Harder to Prosecute

(09/13/2013) Christopher Mallios, with AEquitas: The Prosecutor's Resource on Violence Against Women, said that Ohio prosecutors should have a strong argument in cases where a rape victim later dies because of a 2006 Ohio Supreme Court case.

Justices in State v. Stahl said that a medical examination after a rape was not technically part of the legal process. The decision allowed prior out-of-court statements of victims to sexual assault nurses into evidence, even though the victim was not available to testify about the statement.
